II.4) Short description of the contract (size, scope, type and quantity of supplies, services or works or determine the need and requirements) in the case of innovation partnerships, - identify the need for an innovative product, service or works: 1. The contract works are works related to the implementation of investment involving the design, construction (reconstruction, construction), commissioning and servicing of domestic hot water using solar systems, to support the production of hot water in private homes and public buildings in the Municipality of Siewierz in the framework of the project: "the use of renewable energy sources by the construction of the installation of solar panels in residential and public buildings in the commune Siewierz." 2. The project will be implemented for up to 460 residential buildings (including building rectory) and 9 public buildings Commune Siewierz. The 460 residential buildings and 3 public buildings must expand / remodel an existing installation of hot water using solar systems, including solar panels. The 6 public buildings should build a new installation of hot water using solar systems, including solar panels. 3. The Contracting Authority reserves the right to limit the amount of ordered works and services for residential buildings, but not less than 360 residential buildings. For orders less works and services than the estimated 460 residential contractor will not be requested claims to the Purchaser. Salary will be determined as-built calculation, based on the unit prices of works and services covered by the contract referred to by the Contractor in the price calculation Appendix 7 of the Terms of Reference in accordance with the amount of work actually performed, confirmed by the Purchaser. 4. Employer indicates that the price calculation referred to in paragraph 3, the price concept for the type of the solar system can not exceed 2% of the price for the construction of the type of the solar system, the price of the project documentation for the type of the solar system may not exceed 5% prices for the construction of the type of the solar system, the price of the project documentation for the public building shall not exceed 7% of the price for the execution of works in the public building. 5. The Contractor shall execute the order for 460 residential buildings in the event of the conclusion by the Employer contracts with the owners of 460 buildings. Currently, the procedure for signing in / in contracts. 6. Implementation of the tasks will be using the "Design and Build". 7. The project is co-financed by the European Union from the European Regional Development Fund under the Regional Operational Programme of Silesia for the years 2014-2020. 8. Each of the 469 solar systems must be marked in a conspicuous place the sticker / label informing grants awarded in accordance with the labeling projects under the Regional Operational Programme of Silesia for the years 2014 - 2020. 9. Scope of design work within the framework of the contract includes in particular a) make the necessary expertise - before the task Contractor will verify at its own expense the output to the design provided by the Employer. The selected contractor will receive from the Purchaser a list of persons and buildings covered by the execution of the contract and questionnaire selection of the solar system for installation of hot water, b) development of design documentation necessary for the expansion and reconstruction of the domestic hot water for residential buildings - up to 460 buildings and utility facilities public - 3 buildings, together with the necessary repair works and the electric power (4 kpl. documentation in the paper version + electronic version for each building), c) designing construction hot water installation in 6 public buildings that do not have such an installation (4 kpl. documentation in the paper version + electronic version for each building), d) protocol to agree on the initial installation concept with the property owner and the Purchaser, which is a prerequisite for accession to the design and implementation tasks. The concept should include, inter alia, a detailed definition of the venue of the devices and the method of installation. e) obtaining the required regulations approvals, permits, applications, etc. 10. The scope of works within the framework of the contract includes in particular: a) the execution of works in various buildings on the basis of project documentation drawn up, based on the guidelines PFU, b) performing start-up DHW with solar kit, c) the controls, trial, launch, and control of domestic hot water. 11. The execution of works will be able to proceed with the preparation of project documentation made and supplied by the Contractor, approved by the Employer / Supervisor and obtaining required under the agreements, permits, applications, etc. / If they are necessary /. 12. A detailed description of the scope and design works and construction works is contained in the functional and operational program (PFU) which is annexed hereto. The location of individual solar systems may vary within the Commune Siewierz. 13. The contractor will be required in addition to: a) training users about the rules of proper operation of installations made with the protocol training and the development and transfer of manual installation, b) the execution and delivery of as-built documentation of the complete installation of hot water c) of works and safety of replacement, according to the project, d) the execution of all works associated, in line with the design and proper technology works execution, e) to perform the necessary studies, tests and measurements, and all tests, tests and measurements on each command investor's supervision inspector, in order to determine the accuracy of performed works, f ) to notify the Employer of work to be covered up or disappearing, g) performance of research, testing and commissioning, as well as to make the pits for not filing works for the reception to be covered up or disappearing, h) to ensure the construction of the authorized surveillance and supervision, as well as the appropriate safety conditions and health, and) the removal date of the construction site of unnecessary materials, waste and garbage, j) ordering the construction site after the completion of the works and handing it to the Employer / User no later than the final acceptance, k) to perform other work necessary for the proper execution of the subject orders. l) maintenance (including replacement of fluids) throughout the warranty period. During the warranty period is valid Contractor free service and free installation overview at least 1 once a year and in the fifth year replacement of the heating medium for all installed systems. 14. Other terms of the contract: 1) The Contracting Authority requires that offered by the Contractor work / equipment / materials meet all the requirements set in the functional and operational program / PFU /. 2) The Contractor is obliged to ongoing cooperation with the Employer and the User to coordinate the proper performance of work. 3) detailed scope of work will be included in the schedule of works and expenditures prepared on the basis of the functional program, the Terms of Reference, price calculation and guidance Employer and will be attached as an appendix to the agreement. The Contractor will present ordering schedule for approval within 7 days from the date of signing the contract. In justified cases, the Contractor during the execution of works is obliged to update the material and financial schedule at the request of the Purchaser within 3 days and present it to the Employer for approval. The update schedule does not need to change provisions of the agreement in the form of an annex. 4) Depending on the respective arrangements made subject to the following stages of acceptance: a) receiving partial - reception of the project documentation is done after delivery the Purchaser 4 copies. Hard copy and 1 copy. Electronic version of the complete project documentation containing all the arrangements and administrative provisions necessary to build, commissioning and start of operation for the specific building. - The receipt of work disappearing and be covered Partial acceptance should be carried out for these elements and parts of installations to which access disappears as a result of the progress of works. After the partial acceptance should draw up a protocol confirming the proper execution of works, the conformity of the installation with the project documentation. - Reception of the hot water system with solar kit in a particular building, the reception is carried out in the manner provided for final acceptance. After the partial acceptance should draw up a protocol confirming the proper execution of works, the conformity of the installation with the project documentation. b) final acceptance Final acceptance is based on the final assessment of the actual execution of the works in terms of quality, quantity and value of all buildings. The total completion of the work and readiness for the final acceptance will be confirmed by the Contractor immediately upon written notice to the Superintendent and the Contracting Authority. The final acceptance of the works will commission appointed by the Employer in the presence of the Superintendent, the Employer and the Contractor. The Commission will work receiving their qualitative assessment on the basis of submitted documents, measurements, visual assessment and compliance of the works with project documentation and program functional and utilitarian. For the final acceptance of DHW must present the following documents: Design documentation with any marked changes, protocols partial acceptances, results of control measurements, documents allowing for use in building construction products, which made installation (declarations of conformity, certificates, etc.) Necessary permits and arrangements under the law. Final acceptance protocol should be completed by the adoption of the installation. 7. The Contractor is obliged to prepare a report on the achievement of the environmental effect determining the value of these indicators after the completion of the task: - additional capacity to produce thermal energy from renewable sources [MW], - estimated annual decrease of greenhouse gas emissions [tonnes CO2 equivalent] - the degree of reduction in PM 10 [tonnes / year]. 15. Solutions equivalent: a) If the functional and operational program and other bidding documents used are trademarks, patents or origin, source, or a particular process, which is characterized by products or services provided by a particular manufacturer or contractor should be treated as indicated for example. Purchaser allows tenders of equivalent solutions if they provide that the execution of the contract with the accompanying documentation. b) Whenever the question is about "a product, material or type system or, for example ..." should be understood as a product, material or system (type, eg.: ..) such as proposed or other of the standard and technical parameters not worse than proposed. All trademarks, trademarks, patents recall, model names, part numbers serve only to determine the technical features and quality materials, and are not an indication of the manufacturer. All trade names used in the description of the contract Employer treats as information specifically, which was used only in order to present the needs of the Employer. The use of performance of the contract equivalent products, in relation to their quality, final destination and their functions and usability. By the quality should be understood to provide the minimum characteristics of the product indicated in the tender documents, contract annexes, project documentation. c) In accordance with art. 30 paragraph. 4 of the PPA in the event of reference in the Terms of Reference, PFU and other documents to the standards, European technical assessments, approvals, technical specifications and technical reference systems, referred to in art. 30 paragraph. 1 point 2 and point. 3 Public Procurement Law, the Purchaser allows solutions equivalent to those described in the documents equivalent. d) In accordance with art. 30 paragraph. 5 of the Public Procurement Law contractor, which refers to a solution equivalent to those described by the Employer is obliged to prove that he offered supplies, services or construction works meet the requirements set by the Employer. e) If required by the PFU labeling and certification, the Employer accepts the labeling and certificates equivalent. 16. Payment terms: Salary will be paid quarterly, transfer to the account of the Contractor. Salary will be determined as-built calculation, based on the unit prices of works and services covered by the contract referred to by the Contractor in the price calculation Appendix 7 of the Terms of Reference in accordance with the amount of actually performed works and services covered by the contract, confirmed by the Purchaser. The basis for the invoice protocol is fault-free reception of partial or final works signed by the Employer Representative and subcontractors statements about no arrears with payment for them, along with evidence proving payment of due wages to subcontractors and further subcontractors. Contractor's invoice for the work performed will be paid within 30 days of receipt of the invoice with the confirmation of the transfer to the bank account indicated by the Contractor. 17. The contractor, awarded the contract to provide the Purchaser warranty, as stated in the tender form - ON. No. 1 hereto. The required minimum warranty period for the object of the contract is 72 months from the date of signing the final acceptance. The contractor may offer a longer warranty period up to 84 months, which will be taken into account during the evaluation and testing of tenders on the terms specified in Part XIX Terms of Reference. 18. The contracting authority sets out the obligation of employment under a contract of work of all persons performing work under the supervision of the construction manager, works manager or Contractor, including the following activities in the field of the contract: to perform plumbing, installation of electrical systems, installation of equipment and installation elements . The obligation of employment under a contract of employment also applies to subcontractors. The Contractor is obliged to include in each contract for subcontracting relevant provisions requiring contractors to work on the contract of employment of all persons engaged in the abovementioned activities. In the course of the contract Employer is entitled to carry out checks to contractors regarding the fulfillment by the Contractor or subcontractor requirement of employment under a contract of employment of persons performing activities mentioned above. Detailed rules for documenting employment under a contract of employment and the control of this obligation by the Employer included in the model contract attached as Annex 6 to the tender documents. 19. The subject of the contract will be made accessible for people with disabilities in accordance with Article. 29, paragraph 5 of the Public Procurement Law. 20. Contractor during the execution of the contract must have a current liability insurance in respect of their operations for an amount not less than 1 000 000,00 zł (say: one million zloty 00/100). Policy (the original or a copy certified as a true copy by the Contractor) will be deposited with the Employer prior to the conclusion of the contract. The Contractor shall maintain the validity of the insurance throughout the duration of the Agreement. If in the course of the contract validity of the insurance policy expires not later than the last day of validity of the insurance policy the Contractor shall submit to the Employer a copy of the policy for a prolonged period of validity. The contractor undertakes to maintain continuous insurance coverage for the duration of the contract, on terms not worse than in the original policy. Every time you change the date of the contract the Contractor shall extend the validity of the policy to date to be determined by the Parties. Failure policy within will be treated as a basis for termination of the contract by the Employer's fault.

determining the object, the size or the scope and the conditions under which the contract will be awarded, as referred to in Article. 67 paragraph. 1 point 6 or Article. 134 para. 6 paragraph 3 of the Public Procurement Law: 1) ordering provides for the procurement of art. 67 paragraph. 1, item 6 of the PPA. 2) The scope of orders will involve the repetition of similar works or services, such as ordering a basic and consistent with the object of the main contract. 3) ordering predicts that the scope of repeated works and services may include up to 100 residential buildings and up to 5 public buildings. 4) ordering predicts that the value of repeated works and services can be up to 1 500 000.00 zł gross. 5) The contract referred to in Article. 67 paragraph. 1 point. 6 of the PPA will be granted under the conditions set forth in the PPL mode, single-source procurement. 6) Unit prices for repeating similar works and services shall be adopted with the offer made to order basic. 7) The Contractor shall proceed to carry out the works or services similar only after the conclusion of the contract, provided the occurrence of circumstances referred to in art. 67, paragraph 1, item 6 of the PPA.
